Title "INDIGENOUS PEOPLES": POLITICAL AND LEGAL ASPECTS OF THE CONCEPT

Abstract The adoption of the "Declaration on the rights of indigenous peoples" by the UN in 2007 actualized in political practice and theoretical and political discourse issues associated with the provision of ethno-national and ethno-linguistic minorities. The Declaration contains a number of provisions that come in conflict with the attitudes of the Russian political leadership that were formed under the influence of the Soviet collapse. The refusal of signature and ratification of the Declaration is argued by the Russian side with having their own concept of the rights of indigenous peoples, with which the UN concept not fully coincide, as well as their own legislation in this field, based on a tradition of more than a decade. Having progressive legislative regulation in the sphere of ensuring the rights of indigenous peoples, Soviet, and subsequently Russian side rightly pointed out that, first, domestic political practice had a major impact on the international concept of the rights of indigenous peoples and, secondly, regulation of postcolonial situations is not applied to Soviet and post-Soviet reality.
